Right of Withdrawal
Information on the statutory right of withdrawal for online purchases of original artworks.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the artwork.
How to exercise the right
To exercise your right of withdrawal, you must inform Atelier Rachel, Stefanie Rachel, Neuer Weg 34 B, 23867 Sülfeld, Germany, email: atelier-rachel@email.de, by an unequivocal statement, for example by letter, email or the electronic withdrawal function on this website, of your decision to withdraw. You may use the model withdrawal form, but this is not mandatory. It is sufficient to send the notice before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us, without undue delay and no later than fourteen days after receiving your withdrawal notice. Unless otherwise agreed, reimbursement will be made using the same means of payment as used for the original transaction. We may withhold reimbursement until we have received the artwork back or you have supplied evidence of having sent it back, whichever is earlier.
Return of the artwork
You must return or hand over the artwork without undue delay and no later than fourteen days after informing us of your withdrawal. You bear the direct cost of returning the artwork. For artworks that cannot normally be returned by post because of their nature, the expected return cost will be specified in the individual offer before the contract is concluded or, where it cannot reasonably be calculated in advance, estimated. You are liable for any diminished value only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the artwork.
Individually commissioned artworks
There is no statutory right of withdrawal for artworks that are not prefabricated and are made on the basis of your individual choice or specification, or are clearly personalised to your needs, in accordance with Section 312g(2)(1) BGB. Statutory rights in the event of defects remain unaffected.
Electronic withdrawal function
Where the contract is concluded through an online user interface and the statutory requirements apply, a prominently placed electronic withdrawal function will be available during the withdrawal period. After submission, you will receive an acknowledgement of receipt on a durable medium without undue delay.
